Ben C. Duniway
Benjamin Cushing Duniway (November 21, 1907 – August 23, 1986) was a United States circuit judge of the United States Court of Appeals for the Ninth Circuit. Education and career Born on November 21, 1907, in Stanford, California, Duniway received a Bachelor of Arts degree in 1928 from Carleton College, a Bachelor of Laws in 1931 from Stanford Law School and a Bachelor of Arts in 1933 from the University of Oxford. He received a Master of Arts in 1964 from the University of Oxford. He entered private practice in San Francisco, California from 1933 to 1942 and from 1947 to 1959. He was a regional attorney for the Office of Price Administration in San Francisco and Washington, D.C. from 1945 to 1947. Senior Status
Senior status is a form of semi- retirement for United States federal judges. To qualify, a judge in the federal court system must be at least 65 years old, and the sum of the judge's age and years of service as a federal judge must be at least 80 years. As long as senior judges carry at least a 25 percent caseload or meet other criteria for activity, they remain entitled to maintain a staffed office and chambers, including a secretary and their normal complement of law clerks, and they continue to receive annual cost-of-living increases. Senior judges vacate their seats on the bench, and the president may appoint new full-time judges to fill those seats. Some U.S. states have similar systems for senior judges. State courts with a similar system include Iowa (for judges on the Iowa Court of Appeals), Pennsylvania, and Virginia (for justices of the Virginia Supreme Court). Temporary Emergency Court Of Appeals
The Temporary Emergency Court of Appeals was established by the United States Congress in December 1971 with exclusive jurisdiction to hear appeals from the decisions of the U.S. district courts in cases arising under the wage and price control program of the Economic Stabilization Act of 1970. Congress authorized the Chief Justice of the United States to appoint to the temporary court three or more district and appeals court judges, each of whom was to serve on a part-time basis for an indefinite term. The court exercised the same powers as a U.S. court of appeals, and it was authorized to prescribe its own rules of practice, which it did when its three district and six circuit court judges convened for the first time in February 1972.
