''The Cohens and Kellys'' is a 1926 American silent comedy film directed by Harry A. Pollard and starring Charles Murray, George Sidney, Kate Price, and Jason Robards Sr. The film is the first of the ''Cohens and Kellys'' film serials. The film is perhaps best known today as the subject of '' Nichols v. Universal Pictures Corp.'', a copyright infringement case, in which Judge Learned Hand articulated the doctrine that copyright protection does not cover the characteristics of stock characters in a story. Plot As articulated in the ''Nichols'' case, The characters were similar to those in the Nichols play, ''Abie's Irish Rose'' which was made into a film in 1928 and in 1946. Mack Swain (born Moroni Swain; February 16, 1876 – August 25, 1935) was a prolific early United States, American film actor, who appeared in many of Mack Sennett’s comedies at Keystone Studios, including the Keystone Cops series. He also appeared in major features by Charlie Chaplin and starred in both the world's first feature length comedy and first film to feature a "movie-within-a-movie" premise. Claude Duval Payton (March 30, 1882 in Centerville, Iowa – March 1, 1955 in Los Angeles, California) was an American actor in many silent films and other films. On stage, Claude Payton toured with the Spooner Stock Company, which was headed by his brother, Corse Payton, and his sister, Cecil Spooner. By 1914, Claude was working at the Thanhouser film producing company in New Rochelle, New York, where he mainly played the roles of villains or lawmen in Western films. Although Claude Payton survived the transition from silent movies to films with sound, in 1935 he was mainly in minor supporting roles in films. Robert Gordon (August 21, 1913 in Pittsburgh – December 1, 1990 in Los Angeles) was an American director and actor. His acting career, in which he was usually credited as Bobby Gordon, began in 1923 while he was a child, and continued through 1939. Nat Carr (August 12, 1886 – July 6, 1944, born Natan Krechevsky ) was an American character actor of the silent and early talking picture eras. During his eighteen-year career, Carr appeared in over 100 films, most of them features. Life and career Carr entered the film industry in the 1925 film, '' His People'', in the featured role of Chaim Barowitz. Although he may have appeared in an earlier film, 1923's ''Little Johnny Jones''. He appeared in the featured role of Levi in ''The Jazz Singer'' in 1927. Olive Hasbrouck (1907–1976) was an American film actress of the silent era. Hasbrouck and her mother moved from Boise to Hollywood, where Hasbrouck attended Hollywood High School. She began working in films as an extra at Universal City. When she was 17, she had the lead female role in ''Ridgeway of Montana''. In January 1929, she signed with First National, with the studio slating her to be the leading lady in ''The Royal Rider''. Hasbrouck retired when sound films were introduced. Vera Pogorelsky Gordon (June 11, 1886 – May 8, 1948) was a Russian-born American stage and screen actress. Early life Vera Pogorelsky was born in Ekaterinoslav, Russia, on June 11, 1886, the daughter of Boris Pogorelsky and Teigan Nemirovsky. Career Pogorelsky was a child actor but she was fired by the directors of the Shevchenko Imperial Company when they learned she was of Jewish heritage. ''Abie's Irish Rose'' is a 1928 early sound ( part-talkie) comedy film directed by Victor Fleming and starring Charles "Buddy" Rogers, Nancy Carroll, Jean Hersholt, and J. Farrell MacDonald.
