Designated Military Officer (ARB)
add One of the official positions that the Office for the Administrative Review of Detained Enemy Combatants appointed to conduct Administrative Review Boards was the Designated Military Officer. Like the Combatant Status Review Tribunals the Administrative Review Boards are "administrative" procedures, not "judicial" procedures. Captives are told the Tribunals and Boards are not sentencing them to punishment, merely deciding whether the USA continues to have a reason to hold them in extrajudicial detention. So they are not entitled to legal representation. Office For The Administrative Review Of Detained Enemy Combatants
The Office for the Administrative Review of the Detention of Enemy Combatants, established in 2004 by the Bush administration's Deputy Secretary of Defense Paul Wolfowitz, is a United States military body responsible for organising Combatant Status Review Tribunals (CSRT) for captives held in extrajudicial detention at the Guantanamo Bay detention camps in Cuba and annual Administrative Review Boards to review the threat level posed by deemed enemy combatants in order to make recommendations as to whether the U.S. needs to continue to hold them captive. Most of the Guantanamo captives have had two Administrative Review Board hearings convened to review their continued detention. On June 22, 2007, an appeal on behalf of Guantanamo captive Fawzi al-Odah contained an affidavit from Stephen Abraham, a lawyer and United States Army reserve officer, which was highly critical of OARDEC's procedures. Administrative Review Board
The Administrative Review Board is a United States military body that conducts an annual review of the detainees held by the United States in Camp Delta in the United States Navy base at Guantanamo Bay, Cuba. The purpose of the Board is to review whether the detainees still represent a threat. American President George W. Bush initially called the detainees " illegal combatants." But, without a formal announcement of the policy change, the Bush Presidency changed their description to " enemy combatant". From July 2004 through March 2005, military authorities conducted a one-time Combatant Status Review Tribunal for each detainee, to confirm whether they had been properly been classified as an "enemy combatant". Combatant Status Review Tribunal
The Combatant Status Review Tribunals (CSRT) were a set of tribunals for confirming whether detainees held by the United States at the Guantanamo Bay detention camp had been correctly designated as "enemy combatants". The CSRTs were established July 7, 2004 by order of U.S. Deputy Secretary of Defense Paul Wolfowitz after U.S. Supreme Court rulings in '' Hamdi v. Rumsfeld'' and ''Rasul v. Bush'' and were coordinated through the Office for the Administrative Review of the Detention of Enemy Combatants. These non-public hearings were conducted as "a formal review of all the information related to a detainee to determine whether each person meets the criteria to be designated as an enemy combatant." Administrative detention is arrest and detention of individuals by the state without trial. A number of jurisdictions claim that it is done for security reasons. Many countries claim to use administrative detention as a means to combat terrorism or rebellion, to control illegal immigration, or to otherwise protect the ruling regime. In a number of jurisdictions, unlike criminal incarceration (imprisonment) imposed upon conviction following a trial, administrative detention is a forward-looking mechanism. Evidence for a proposition is what supports this proposition. It is usually understood as an indication that the supported proposition is true. What role evidence plays and how it is conceived varies from field to field. In epistemology, evidence is what justifies beliefs or what makes it rational to hold a certain doxastic attitude. Every Administrative Review Board, run under the authority of the Office for the Administrative Review of Detained Enemy Combatants, was commanded by a Presiding Officer. Like the Combatant Status Review Tribunals, also run by OARDEC, the Boards form were modeled after the US Department of Defense's Army Regulation 190-8 Tribunals, but differed in its mandate. All three procedures consisted of at least three officers, of whom the most senior was to be of field grade. The AR 1900-8 Tribunals was to set out the details of how the US military was to comply with the US's obligations, under the Third Geneva Convention, to convene a "competent tribunal" to determine the status of captives whose status was in doubt.
