The Land and Environment Court of New South Wales is a court within the Australian court hierarchy established pursuant to the to hear environmental, development, building and planning disputes. The Court’s jurisdiction, confined to the state of New South Wales, Australia, includes merits review, judicial review, civil enforcement, criminal prosecution, criminal appeals and civil claims about planning, environmental, land, mining and other legislation. History The Court was established on 1 April 1980 as the world's first environmental court that was also a superior court of record. New South Wales Court Of Criminal Appeal
The New South Wales Court of Criminal Appeal, part of the Supreme Court of New South Wales, is the highest court for criminal matters and has appellate jurisdiction in the Australian State of New South Wales. Jurisdiction The Court hears appeals from people who were convicted or pleaded guilty and were sentenced by a Supreme or District court judge. The Court also hears appeals lodged by The Crown regarding the adequacy of a sentence. Decisions made by the Land and Environment Court, the Industrial Court or the Drug Court in criminal jurisdiction may also be brought for appeal. The Court of Criminal Appeal may also grant leave to appeal in matters involving questions of fact or mixed questions of fact and law. A court of record is a trial court or appellate court in which a record of the proceedings is captured and preserved, for the possibility of appeal. A court clerk or a court reporter takes down a record of oral proceedings. That written record (and all other evidence) is preserved at least long enough for all appeals to be exhausted, or for some further period of time provided by law (for example, in some U.S. states, death penalty statutes provide that all evidence must be preserved for an extended period of time). Robert Neville (Angus) Talbot is an Australian lawyer and barrister. He is a retired Judge of the Land and Environment Court of New South Wales and the immediate past Chairman of the Executive Committee of the Council of Newington College. Peter McClellan
Peter David McClellan is a retired judge of the New South Wales Court of Appeal who served between February 2013 and February 2018. McClellan was the Chief Royal Commissioner of the Royal Commission into Institutional Responses to Child Sexual Abuse from January 2013 to December 2017. He was previously the Chief Judge in Common Law in the Supreme Court, a position to which he was appointed in 2005. Early life and education McClellan grew up on Sydney's Upper North Shore, and received his secondary school education at Normanhurst Boys High School. Mahla Liane Pearlman (2 June 1937 – 2 December 2011) was an Australian lawyer and chief judge of the Land and Environment Court of New South Wales from 1992 to 2003. Early life and education Pearlman was born in Boggabri, New South Wales, the daughter of Minnie and Mark Pearlman. She attended Boggabri Public School with her younger brother Braham. She later attended MLC School in Burwood. She studied at the University of Sydney where she graduated with a Bachelor of Arts in 1957 and a Bachelor of Laws with Honours in 1960. Career Pearlman was admitted as a solicitor on 11 March 1960 and in 1981 became the first woman President of the Law Society of New South Wales. James Robert McClelland (3 June 1915 – 16 January 1999) was an Australian lawyer, politician, and judge. He was a member of the Australian Labor Party (ALP) and served as a Senator for New South Wales from 1971 to 1978. He briefly held ministerial office in the Whitlam Government in 1975 as Minister for Manufacturing Industry and Minister for Labor and Immigration. He later served as the inaugural Chief Judge of the Land and Environment Court of New South Wales from 1980 to 1985, as well as presiding over the 1984 McClelland Royal Commission into British nuclear tests in Australia. Timothy John Moore (born 8 November 1948) is a Judge of the NSW Land and Environment Court and a former Australian politician. He was the Liberal member for Gordon in the New South Wales Legislative Assembly from 1976 to 1992, and Minister from the Environment from 1989 to 1992.
