Human Rights Abuses In Jammu And Kashmir
Human rights abuses in Jammu and Kashmir range from mass killings, enforced disappearances, torture, rape and sexual abuse to political repression and suppression of freedom of speech. The Indian Army, Central Reserve Police Force (CRPF), Border Security Personnel (BSF) have been accused for committing severe human rights abuses against Kashmiri civilians. According to Seema Kazi, militant groups have also been held responsible for similar crimes, but the vast majority of abuses have been perpetrated by the armed forces of the Indian government. Some rights groups say more than 100,000 people have died since 1989 while the official figures from Indian sources state the estimates of number of civilians killed due to the insurgency as above 50,000. Village Defence Committees
Village Defence Guards (VDGs) formerly known as Village Defence Committees is a civilian militia first established in the mid-1990s in the Chenab Valley area of Indian-administered territory of Jammu and Kashmir for the self-defence of locals, especially Hindus, in remote hilly villages against militancy. It consist of villagers as well as police officers. The VDGs have been accused of numerous human rights violations including dozens of murder and rape cases. On 15 August 2022, Government of Jammu and Kashmir accorded sanction to the creation of the VDG. VDG members are paid a monthly remuneration of 4,000-4,500 Indian rupees (US$48-$54). In the 1990s, according to official data, at least 221 cases including nearly two dozen related to murder, seven to rape, and 15 cases involving rioting were registered against the members of the VDGs. Child Soldiers In India
Child soldiers in India is a common occurrence among non-state forces such as insurgent organizations and up to seventeen militant factions use child soldiers in the Kashmir region. According to a report from the Conflict Study Center, child soldiers are used in Assam, Manipur, Nagaland, Andhra Pradesh, Chhattisgarh, Jharkhand, Karnataka, Maharashtra and Jammu and Kashmir; and that children were used by both state backed and anti-state insurgent groups. Use of children below the age of 18 in active conflict is a violation of the Indian Penal Code, the Geneva convention and the Convention on the Rights of the Child. Revocation Of The Special Status Of Jammu And Kashmir
On 5 August 2019, the Parliament of India voted in favour of a resolution tabled by Home Minister Amit Shah to revoke the temporary special status, or autonomy, granted under Article 370 of the Indian Constitution to Jammu and Kashmir—a region administered by India as a state which consists of the larger part of Kashmir which has been the subject of dispute among India, Pakistan, and China since 1947. Among the Indian government actions accompanying the revocation was the cutting off of communication lines in the Kashmir Valley restored after 5 months.
