Graymail
Graymail is the threatened revelation of state secrets in order to manipulate legal proceedings. It is distinct from blackmail, which may include threats of revelation against, and manipulation of, any private individual. Graymail is used as a defense tactic, forcing the government to drop a case to avoid revealing national secrets. Graymail can occur in two ways: # To straightforwardly blackmail the government, forcing it to drop the case using the threat that if the trial proceeds the defendant will reveal classified information he or she already knows. # To request use of classified material, e.g. as evidence, in the trial. The defendant speculates that the government will be unwilling to make the material fully available to the case, and that this will raise the possibility, in the eyes of the judge or jury, that the unreleased material might clear the defendant, making it difficult to prove guilt. Katharine Teresa Gun (''née'' Harwood) (born 1974) is a British linguist who worked as a translator for the Government Communications Headquarters (GCHQ). In 2003, she leaked top-secret information to ''The Observer'', concerning a request by the United States for compromising intelligence on diplomats from member states of the 2003 Security Council. The diplomats were due to vote on a second United Nations resolution on the prospective 2003 invasion of Iraq. Silent Witness Rule
The silent witness rule is the use of "substitutions" when referring to sensitive information in the United States open courtroom jury trial system. An example of a substitution method is the use of code-words on a "key card", to which witnesses and the jury would refer during the trial, but which the public would not have access to. The rule is an evidentiary doctrine that tries to balance the state secrets privilege with the bill of rights (especially the right of the accused to a public trial, and the right to due process). In practice the rule has been rarely used and was often challenged by judges and civil rights advocates. Its use remains controversial.
