Prior to his election to the Scottish Parliament, Don was a councillor (2003–2007) for Ninewells ward, and SNP Group Convenor on
Dundee City Council

2007 election and was elected from the SNP's regional list for the North East Scotland.

2011 election he was elected for the Angus North and Mearns constituency. He was a Member of the Justice Committee and the Public Petitions Committee.
Don was Convenor of the Delegated Powers 2011–2013 then Convener of the Law Reform Committee 2013–2016.
