In English common law, fee tail or entail is a form of trust established by deed or settlement which restricts the sale or inheritance of an estate in real property and prevents the property from being sold, devised by will, or otherwise alienated by the tenant-in-possession, and instead causes it to pass automatically by operation of law to an heir determined by the settlement deed. The term ''fee tail'' is from Medieval Latin , which means "cut(-short) fee" and is in contrast to "fee simple" where no such restriction exists and where the possessor has an absolute title (although subject to the allodial title of the monarch) in the property which he can bequeath or otherwise dispose of as he wishes. Equivalent legal concepts exist or formerly existed in many other European countries and elsewhere. Mark Rolle
Hon. Mark George Kerr Rolle (1835–1907; Mark George Kerr Trefusis), of Stevenstone, St Giles in the Wood, Devon, was High Sheriff of Devon in 1864, a DL of Devon and High Steward of Barnstaple. Due to an inheritance from his uncle by marriage, John Rolle, 1st Baron Rolle (1750–1842), he became the largest private landowner in Devon, and according to the Return of Owners of Land, 1873 his landholdings, of which he was life-tenant under his uncle's will, extended to 55,000 acres. He was a prolific philanthropist and builder and restorer of churches, farmhouses and cottages, the latter for his estate workers. In English law, a fee simple or fee simple absolute is an estate in land, a form of freehold ownership. A "fee" is a vested, inheritable, present possessory interest in land. A "fee simple" is real property held without limit of time (i.e., permanently) under common law, whereas the highest possible form of ownership is a "fee simple absolute," which is without limitations on the land's use (such as qualifiers or conditions that disallow certain uses of the land or subject the vested interest to termination). A life interest (or life rent in Scotland) is a form of right, usually under a trust, that lasts only for the lifetime of the person benefiting from that right. A person with a life interest is known as a life tenant. A life interest ends when the life tenant dies. An '' interest in possession trust'' is the most common example of a ''life interest trust''. In a typical interest in possession trust, the life tenant receives all the income from the trust for the rest of his or her life. In property law and real estate, a future interest is a legal right to property ownership that does not include the right to present possession or enjoyment of the property. Future interests are created on the formation of a defeasible estate; that is, an estate with a condition or event triggering transfer of possessory ownership. A common example is the landlord-tenant relationship. The landlord may own a house, but has no general right to enter it while it is being rented. The conditions triggering the transfer of possession, first to the tenant then back to the landlord, are usually detailed in a lease. The Law of Property Act 1925c 20 is a statute of the United Kingdom Parliament. It forms part of an interrelated programme of legislation introduced by Lord Chancellor Lord Birkenhead between 1922 and 1925. The programme was intended to modernise the English law of real property. The Act deals principally with the transfer of freehold or leasehold land by deed. The Statute of Westminster of 1285, also known as the Statute of Westminster II or the Statute of Westminster the Second, like the Statute of Westminster 1275, is a code in itself, and contains the famous clause '' De donis conditionalibus'', one of the fundamental institutes of the medieval land law of England. William Stubbs says of it: Most of the statute was repealed in the Republic of Ireland in 1983 and the rest in 2009. Chapters The Statute of Westminster II is composed of 50 chapters. The landed gentry, or the ''gentry'', is a largely historical British social class of landowners who could live entirely from rental income, or at least had a country estate.
