Section 295A Of The Indian Penal Code
Section 295A of the Indian Penal Code lays down the punishment for the deliberate and malicious acts, that are intended to outrage religious feelings of any class by insulting its religion or religious beliefs. It is one of the Hate speech laws in India. This law prohibits blasphemy against all religions in India. Section 295A is a cognisable, non-bailable, and non-compoundable offence. Legal experts consider Section 295A a controversial provision. They believe that there are good legal arguments for the court to revisit and consider overruling the constitution bench judgement in ''Ramji Lal Modi v. State of UP''. Indian Penal Code
The Indian Penal Code (IPC) was the official criminal code of the Republic of India, inherited from British India after independence. It remained in force until it was repealed and replaced by the Bharatiya Nyaya Sanhita (BNS) in December 2023, which came into effect on July 1, 2024. It was a comprehensive code intended to cover all substantive aspects of criminal law. The Code was drafted on the recommendations of the first Law Commission of India established in 1834 under the Charter Act 1833 under the chairmanship of Thomas Babington Macaulay. It came into force in the subcontinent during the British rule in 1862. However, it did not apply automatically in the Princely states, which had their own courts and legal systems until the 1940s. The Gyanvapi Mosque is a mosque located in Varanasi, in the state of Uttar Pradesh, India. The mosque was constructed in Common Era, CE, a decade after Aurangzeb's demolition of a Shiva Hindu temple that was on the site. Mohammed Zubair (born 1983) is an Indian journalist, fact-checker and the co-founder of Alt News, an Indian non-profit fact-checking website. In 2022, Zubair was arrested by Delhi Police over a 2018 tweet for allegedly "insulting Hindu religious beliefs" and incarcerated for a month. His detention raised further concerns about the state of India's press freedom under Narendra Modi's premiership and was widely criticised by journalistic bodies, human rights organisations and the political opposition who allege that the arrest was an act of revenge against his role in Alt News' work of combating disinformation. A fact is a true datum about one or more aspects of a circumstance. Standard reference works are often used to check facts. Scientific facts are verified by repeatable careful observation or measurement by experiments or other means. For example, "This sentence contains words." accurately describes a linguistic fact, and "The Sun is a star" accurately describes an astronomical fact. Further, "Abraham Lincoln was the 16th President of the United States" and "Abraham Lincoln was assassinated" both accurately describe historical facts. Alt News is an Indian non-profit fact checking website founded and run by former software engineer Pratik Sinha and Mohammed Zubair. It was launched on 9 February 2017 to combat fake news. Alt News was a signatory partner of the International Fact-Checking Network until April 2020. History Alt News was founded in Ahmedabad by Pratik Sinha, a former software engineer and son of Mukul Sinha, who was a lawyer and the founder-president of Jan Sangharsh Manch. Pratik Sinha became interested in exposing fake news when he began working with his activist parents in India. Hate Speech Laws In India
The hate speech laws in India aim to prevent discord among its many ethnic and religious communities. The laws allow a citizen to seek the punishment of anyone who shows the citizen disrespect "on grounds of religion, race, place of birth, residence, language, caste or any other ground whatsoever". Section 153A of the Indian Penal Code prohibits citizens from creating disharmony or feelings of enmity, hatred or ill-will between different groups of people. The Constitution The Constitution of India does not provide for a state religion. Article 25(1) states, "Subject to public order, morality and health and to the other provisions of this Part, all persons are equally entitled to freedom of conscience and the right freely to profess, practise and propagate religion".
