Saadeh V. Farouki
''Saadeh v. Farouki'', 107 F.3d 52 (United States Court of Appeals for the District of Columbia Circuit, D.C. Cir. 1997), was a legal case, case decided in the D.C. Circuit that espoused a narrow reading of 28 U.S.C. § 1332(a) in order to limit federal diversity jurisdiction. Factual background Saadeh, a Greek citizen living in Maryland, sued Farouki, a Jordanian citizen with permanent resident status in Maryland, over an unpaid debt in federal court. The district court found for Saadeh, and Farouki appealed on the merits. Decision The court reversed the judgment, citing that the lower federal court lacked jurisdiction because of a lack of diversity. The United States Court of Appeals for the District of Columbia Circuit (in case citations, D.C. Cir.) is one of the thirteen United States Courts of Appeals. It has the smallest geographical jurisdiction of any of the U.S. federal appellate courts, and covers only one district court: the U.S. District Court for the District of Columbia. It meets at the E. Barrett Prettyman United States Courthouse, near Judiciary Square, Washington, D.C. The D.C. Diversity Jurisdiction
In the law of the United States, diversity jurisdiction is a form of subject-matter jurisdiction that gives U.S. federal courts the power to hear lawsuits that do not involve a federal question. For a U.S. federal court to have diversity jurisdiction over a lawsuit, two conditions must be met. First, there must be "diversity of citizenship" between the parties, meaning the plaintiffs must be citizens of different U.S. states than the defendants. Second, the lawsuit's "amount in controversy" must be more than $75,000. If a lawsuit does not meet these two conditions, U.S. federal courts will normally lack the power to hear it unless it involves a federal question, and the lawsuit would need to be heard in state court instead. The United States Constitution, in Article III, Section 2, grants Congress the power to permit federal courts to hear diversity cases through legislation authorizing such jurisdiction.
