Price Waterhouse V. Hopkins
''Price Waterhouse v. Hopkins'', 490 U.S. 228 (1989), was a landmark decision of the US Supreme Court on the issues of prescriptive sex discrimination and employer liability for sex discrimination. The employee, Ann Hopkins, sued her former employer, the accounting firm Price Waterhouse. She argued that the firm denied her partnership because she did not fit the partners' idea of what a female employee should look and act like. The employer failed to prove that it would have denied her partnership anyway, and the Court held that constituted sex discrimination under Title VII of the Civil Rights Act of 1964. The significance of the Supreme Court's ruling was twofold. First, it established that gender stereotyping is actionable as sex discrimination. Ann Hopkins (December 18, 1943 – June 23, 2018) was an American business manager who was the plaintiff in the landmark American employment discrimination case ''Price Waterhouse v. Hopkins''. Early life and education Ann Branigar Hopkins was born in Galveston, Texas, the oldest of three children, but she and her siblings grew up in Germany. Her family moved around every few years, within both Europe and the U.S., as a result of her father's military service. Hopkins attended Hollins College in Virginia, earning a bachelor's degree in 1965. She continued on to Indiana University, where she completed a master's degree in mathematics in 1967. Mixed Motive Discrimination
"Mixed motive" discrimination is a category of discrimination under Title VII of the Civil Rights Act of 1964. Where the plaintiff has shown intentional discrimination in a mixed motive case, the defendant can still avoid liability for money damages by demonstrating by a preponderance of the evidence that the same decision would have been made even in the absence of the impermissible motivating factor. If the defendant establishes this defense, the plaintiff is then entitled only to declaratory and injunctive relief, attorney's fees, and costs.
