The judiciary of Germany is the system of courts that interprets and applies the law in Germany. The German legal system is a civil law (legal system), civil law mostly based on a comprehensive compendium of statutes, as compared to the common law systems. In criminal and administrative law, Germany uses an inquisitorial system where the judges are actively involved in investigating the facts of the case, as compared to an adversarial system where the role of the judge is primarily that of an impartial referee between the prosecutor or plaintiff and the defendant or Defense (legal), defense counsel. Article 48 (Weimar Constitution)
Article 48 of the constitution of the Weimar Republic of Germany (1919–1933) allowed the Reich president, under certain circumstances, to take emergency measures without the prior consent of the Reichstag. This power came to be understood to include the promulgation of emergency decrees. It was used frequently by Reich President Friedrich Ebert of the Social Democratic Party to deal with both political unrest and economic emergencies. Later, under President Paul von Hindenburg and the presidential cabinets, Article 48 was called on more and more often to bypass a politically fractured parliament and to rule without its consent. Napoleonic Code
The Napoleonic Code (), officially the Civil Code of the French (; simply referred to as ), is the French civil code established during the French Consulate in 1804 and still in force in France, although heavily and frequently amended since its inception. A lay judge, sometimes called a lay assessor (law), assessor, is a person assisting a judge in a trial. Lay judges are used in some civil law (legal system), civil law jurisdictions.
