European Union Design
A European Union design is a unitary industrial design right that covers the European Union. It has both unregistered and registered forms. The unregistered Community design (UCD) came into effect on 6 March 2002 and the registered Community design (RCD) was available from 1 April 2003. The name ''community design'' was changed to European Union design (EU design) by Regulation (EU) 2024/2822. This change will take effect on 1 May 2025. Legal basis Council Regulation (EC) No 6/2002, as implemented by Commission Regulation (EC) No 2245/2002, created both unregistered and registered European Community designs. The Community design is a unitary right that has equal effect across the European Union. Industrial Design Right
An industrial design right is an intellectual property right that protects the visual design of objects that are purely utilitarian. An industrial design consists of the creation of a shape, configuration or composition of pattern or color, or combination of pattern and color in three-dimensional form containing aesthetic value. An industrial design can be a two- or three-dimensional pattern used to produce a product, industrial commodity or handicraft. Under the Hague Agreement Concerning the International Deposit of Industrial Designs, a WIPO-administered treaty, a procedure for an international registration exists. To qualify for registration, the national laws of most member states of WIPO require the design to be novel. An applicant can file for a single international deposit with WIPO or with the national office in a country party to the treaty. EUIPO
The European Union Intellectual Property Office (EUIPO) () is a decentralised agency of the EU responsible for the registration of EU-wide unitary trade marks and industrial design rights. These exist alongside the intellectual property rights of individual EU member states, so the agency also works to harmonise EU-wide and national registration processes. Other responsibilities include the administration of the rights of certain products in the EU to carry geographical indications. EUIPO was founded in 1994 and was formerly known as the Office for Harmonization in the Internal Market (OHIM), but was renamed in March 2016 to reflect major reforms.
