California's Talent Agencies Act
The Talent Agencies Act. is a law in the U.S. state of California which sets regulations for talent agents. Noncompliance with the statute on the part of the agent allows actors, writers and other artists to disgorge their financial obligations by petitioning the California Department of Industrial Relations, alleging their talent representatives found them work without having a talent agency license. This may expose unlicensed personal managers to significant potential liability. The Labor Commissioner's enforcement of the law led to personal managers forfeiting an estimated $500,000,000 in otherwise-owed commissions. These forfeitures are based on the authority given by a 1967 case, ''Buchwald v. Superior Court'', 254 Cal. App. 2d 347, a suit initiated by the Jefferson Airplane founder to remove the contractual rights of its personal manager. Talent Agent
A talent agent, or booking agent, is a person who finds jobs for actors, authors, broadcast journalists, film directors, musicians, models, professional athletes, screenwriters, writers, and other professionals in various entertainment or sports businesses. In addition, an agent defends, supports and promotes the interest of their clients. Talent agencies specialize, either by creating departments within the agency or developing entire agencies that primarily or wholly represent one specialty. For example, there are modeling agencies, commercial talent agencies, literary agencies, voice-over agencies, broadcast journalist agencies, sports agencies, music agencies and many more. Having an agent is not required, but does help the artist in getting jobs (concerts, tours, movie scripts, appearances, signings, sport teams, etc.). The California Department of Industrial Relations (DIR) is a department of the government of the state of California which was initially created in 1927. The department is currently part of the Cabinet-level California Labor and Workforce Development Agency, and headquartered at the Elihu M. Harris State Office Building in Oakland.
