Family Separation
Family separation is the condition where family members are involuntarily separated from each other, often because of immigration systems, although it can happen for other reasons such as military service or involuntary adoption. Family separation can have a serious impact on mental health. Because family separation interferes with the right to family life, family reunification is a reason for immigration in many countries. Right To Family Life
The right to family life is the right of all individuals to have their established family life respected, and to have and maintain family relationships. This right is recognised in a variety of international human rights instruments, including Article 16 of the Universal Declaration of Human Rights, Article 23 of the International Covenant on Civil and Political Rights, and Article 8 of the European Convention on Human Rights. Definition The changing concept of family requires a subjective definition of what family entails. There is no contest that the relationship between husband and wife, unmarried (de facto) partners, parents and children, siblings, and ‘near relatives’ such as between grandparents and grandchildren represents family as required under the right to family life. Family Reunification
Family reunification is a recognized reason for immigration in many countries because of the presence of one or more family members in a certain country, therefore, enables the rest of the divided family or only specific members of the family to emigrate to that country as well. Family reunification laws try to balance the right of a family to live together with the country's right to control immigration. However, what the balance looks like and which members of the family can be reunited differ largely by country. A subcategory of family reunification is marriage migration in which one spouse immigrates to the country of the other spouse. Marriage migration can take place before marriage and then falls under its own special category, or it can take place after marriage and then falls under family reunification laws. Trump Administration Family Separation Policy
The United States family separation policy under the Trump administration was presented to the public as a "zero tolerance" approach intended to deter illegal immigration and to encourage tougher legislation. In some cases, families following the legal procedure to apply for asylum at official border crossings were also separated. It was officially adopted across the entire US–Mexico border from April 2018 until June 2018. Under the policy, federal authorities separated children and infants from parents or guardians with whom they had entered the US. The adults were prosecuted and held in federal jails or deported, and the children were placed under the supervision of the US Department of Health and Human Services. The Stolen Generations (also known as Stolen Children) were the children of Australian Aboriginal and Torres Strait Islander descent who were removed from their families by the Australian federal and state government agencies and church missions, under acts of their respective parliaments. Family disruption is a term referring to events that disrupt the structure of individual families. These events include divorce, legal separation, and parental death, out of home placement, and deployment. Researchers have been studying the effects on youth for decades.
