''Reeves v CH Robinson Worldwide, Inc'', 5 No. 07-10270 (11th Cir. January 20, 2010) is a US labor law case under Title VII of the Civil Rights Act of 1964 heard before the United States Court of Appeals for the Eleventh Circuit which ruled that a hostile work environment can be created in a workplace where sexually explicit language and pornography are present. A hostile workplace may exist even if it is not targeted at any particular employee. Facts Ms. Reeves was the only woman working in her area as a transportation sales representative in the Birmingham, Ala., office of C.H. Robinson, an Eden Prairie, Minnesota-based transportation services firm. In her lawsuit she claimed that "sexually offensive language permeated the work environment" from both her co-workers and her supervisor. Harassment covers a wide range of behaviors of offensive nature. US Labor Law
United States labor law sets the rights and duties for employees, labor unions, and employers in the United States. Labor law's basic aim is to remedy the "inequality of bargaining power" between employees and employers, especially employers "organized in the corporate or other forms of ownership association". In United States labor law, a hostile work environment exists when one's behavior within a workplace creates an environment that is difficult or uncomfortable for another person to work in, due to illegal discrimination. Common complaints in sexual harassment lawsuits include fondling, suggestive remarks, sexually-suggestive photos displayed in the workplace, use of sexual language, or off-color jokes. Small matters, annoyances, and isolated incidents are usually not considered to be statutory violations of the discrimination laws. For a violation to impose liability, the conduct must create a work environment that would be intimidating, hostile, or offensive to a reasonable person.
