R V O'Connor
''R v O'Connor'', 9954 S.C.R. 411 is a leading Supreme Court of Canada decision on disclosure of medical records. O’Connor was accused of and charged with rape and indecent assault of four women. The Court held that the medical and counselling records of a complainant in a sexual assault case that are held by a third party can be disclosed by order of the judge if they meet two requirements. First, the applicant must establish, without seeing them, that the records are likely to be relevant to the case. Second, the judge must review the records and decide whether to disclose them based on the balancing the right to make full answer and defence, and the right to privacy. The O'Connor involved in the case was Hubert Patrick O'Connor, a Catholic bishop from British Columbia who was found guilty of sex crimes in 1991. The Supreme Court Reports (S.C.R.) is the official reporter (law), reporter of the Supreme Court of Canada. Since the creation of the Supreme Court, all of its decisions have been published in the Reports, in both English language, English and French language, French. The first volume was published in 1877 containing the first case ever heard by the Supreme Court, ''Kelly v. Sullivan''. Initially, the reports were identified from 1 to 64, but from 1923 they have been identified by their year of publication. By 1975 the reporter started putting out two volumes a year, which increased to between 3 and 4 by 1990. Volumes from 1983 and later are also available in electronic format, hosted by LexUM at the Université de Montréal. Hubert Patrick O'Connor
Hubert Patrick O'Connor (17 February 1928 — 24 July 2007) was a Canadian Catholic bishop from Huntingdon, Quebec who was famously forced to resign from the church following charges of multiple sex crimes stemming from his time as principal at the Saint Joseph's Mission Residential School in Williams Lake. At the time, he was the highest ranking Catholic official in the world to ever be charged with a sex crime. Church career O'Connor was ordained to the priesthood on 5 June 1955 with the Oblates of Mary Immaculate after studying in Ottawa, Ontario. He worked within the church until being sent to Williams Lake as the principal of Saint Joseph's Mission from 1961 to 1967.
